Is our builder ripping us off?

Desperate Advice Needed. We bought a new house before construction was completely finished and moved in March 1st along with a builders promise that all would be completed "as soon as the weather improves".

Money was supposedly escroed to cover the painting of the cedar sidings, landscaping, hot-top (tar drive) and planting of shrubs Builders rubble to be removed from the front of our garage - including large empty gas cylinders etc. We never received a copy as his lawyers never responded to our lawyer's request for a copy of them. A temporary wooden box holds up our outdoor staircase to our house - we were promised a concrete base.

It's now July 14th. None of the above has been completed. The builder moved in next door, he built only two houses on the subdivision - ours and his. We don't see him, but his wife always puts us off with "I'll ask him about it" and we never hear anything else.

We were trying to remain on friendly terms as these are our new neighbours; but got worried when we heard some stories from other neighbours whom are very angry about his empty promises of repairing the damage done to their property to make way for the new construction. He had promised them fences and to generally tidy up the whole area which was previously a mix of woodland and wetlands.

According to P&S agreement, the painting of the house should be completed by May 15th and garden loamed and seeded etc by June 1st.

Buying the house left us without extra money for lawyers, so we don't want to embark on costly legal proceedings without first finding out where we stand.

Advice is desperately needed. We are not familiar with US laws as we were moved here from the UK by my husband's company.

What has your lawyer done since requesting a copy of the documentation?
Has your lawyer sent a demand letter to complete the construction of the home?

Our lawyer is a friend of ours that works primarily in medical matters. She helped us close the deal on the house as a favor. However, she said she was unable to locate the builder's lawyer, no calls were answered and she just received an answering machine.

Should she be issuing a demand letter?

I thought of that but we just dont have that kind of cash lying around and what if we lose? We just don't know if the law is with us or against us in this situation.

**A: well at least talk to a construction litigator via a free consultation.
