What is the name of your state (only U.S. law)? NV Can someone tell me if bankruptcy can be filed by only one half of a married couple if the debt was incurred long before he got remarried? We have proof that the debt was only from him, and did not occur after the second marriage. Any help would be great. Thank you.

Yes, one spouse is allowed to file.
However, the nonfiling spouse will have to disclose their income as well as there share of HH expenses plus, debts they are solely responsible for. This is to determine if there is enough HH income to support a Chapter 13 plan.
