You're wrong about the game too. High scores are achieved through a CONTROLLED SWING, not by swinging as hard as you can. If you swing too hard, you overshoot and score worse. The game itself does not encourage injury.

Go play the game before you form any more theories about the possibility of injuries.
That would require sagito to have friends, wouldn't it, since he said he didn't own a Wii? :p

There is no opportunity to negotiate the contract after the game has been purchased...and THAT is why the company could be held accountable.

I can assure you that if you were not warned prior to purchase and discovered after the purchase by material within the packaging only, Nintendo would refund you your money.

Did you guys ever consider the possibility that the op has poor mechanics? We are talking about simulating a game that professional athletes play (whether Tennis, Golf, or Baseball) who have years of experience.

If a high school kid who doesn't know how to play golf tries to audition for the school team and hits himself in the head with the club, which causes a concussion, you don't sue the school.

Maybe the op should take tennis lessons to learn the proper way to swing a tennis racket or golf club before attempting such a dangerous game...lol.

This is insane.
