What is the name of your state (only U.S. law)? California

ok so I was busted for possesion of less than .5 grams has oil (a felony I believe) and less than 2 grams marijuana. I am a medical marijuana card holder but was arrested and taken to jail anyway. Im not really sure what to expect since I have no previous record have good grades and am on my way to college.

What should i be expecting in terms of punishment (probation, com service, or fine, or combo). I really do not want to have probation and would like to get this cleared from my record but i do not have the money to go to trial with this nor do i wish to go through the painstaking prosess of a trail. Any advice, help, or experience and knowledge with something similar would be great.

I actually havent even seen those all I was given after release from Jail was a notice to appear at court for an araignment which I went to but was told my case had not yet been reviewed that was about a week ago and now im left to wonder how long do i wait.:confused:

The paperwork should have code sections written on them - those are the numbers that will be needed if there is any hope to evaluate the matter and give you an idea of what to expect. At this point, I can guess, but it might be wrong as the officers may have cited you incorrectly, and the DA may charge something else.

I am assuming HS 11357 for the marijuana and i cant seem to find one for concentrated cannabis.:confused:
They cannot book you for the H&S 11357(b), so if that was the only thing charged, they made a big "oops".

They might have charged you with H&S 11357(a), however:

11357. (a) Except as authorized by law, every person who possesses
any concentrated cannabis shall be punished by imprisonment in the
county jail for a period of not more than one year or by a fine of
not more than five hundred dollars ($500), or by both such fine and
imprisonment, or shall be punished by imprisonment in the state
prison.

After reviewing my release paper it does say that the charge is only for HS11357 (A). so where does that leave me now?

You need an attorney.

And had you been charged SOLELY with possession of marijuana in violation of H&S 11357(b), that is a cite and release issue only. Unless for some reason you could not be issued a citation (such as bad identification, impairment, etc.) they could not house you in the jail for that violation. Essentially, marijuana violations are low grade traffic tickets.

I have an attorney but we are waiting to see what the official charge is and I went for an arraignment but was told my case hadnt been reviewed yet so I have no idea how long i have to wait now, Id like to just get on with my life.

Also it was a conncentrated cannabis i was charged for (Hash oil).

any idea how long i will wait for a new arraignment date? Since it is a first offense will it be a felony

I thought drug use was a requirement in the film industry? :D

Honestly, I doubt it will be an issue for employment in that field. Some employers might have a problem if it is a felony drug conviction, but I suspect you will have an opportunity for diversion to keep this off your record. So, you had best consider ending all drug use now so you will be ready if diversion (Prop 36) is an option for you.

whooooo Viagra never said pronography hahaha im going to be attending Chapman University or USC id hope i become something more than the next Hue Heffner, even though he does make quite a good living ;) hahaha well on a lighter note thank you for all your help and i will post the final out come of the case
