Does he give you any reason why the will is not being probated?
If he won't tell you, then you or whoever the potential beneficiaries might be should hire their own attorney and file at the courthouse to open up probate and ask the judge to demand this person produce the will.
You need to be talking to a trust attorney to find out what rights beneficiaries have in that state to request a copy of the trust and an accounting statement--some states allow it, others do not. So what if the trust is in a company name--if you think that you are a beneficiary mentioned in that trust, you may have a right to request information about the trust which will most likely have information about the assets in it.
