Our company sells certificate incentives over the phone. A customer agreed to pay for the certificates upon receiving them by mail, so will this verbal contract hold up if it is recorded over the phone? Sometimes customers have buyer’s remorse but since that would cause us to lose money, we express ahead of time that it is non-cancelable. Are there laws that give the customer an automatic right to rescission even if we explain that it is non-cancelable? Do we have the right to take them to collections or pursue legal judgment to recover the owed funds? Do the following factors influence our ability to legally collect on this debt: it’s a verbal contract, the contract is recorded, the customer states their name and address and says they agree to the terms. Also are there rescission laws regarding paying/being invoiced for something over the phone? Are there any disclosure requirements (ie: in writing when they receive it they have x amount of days to rescind in writing, etc)?What is the name of your state (only U.S. law)?What is the name of your state (only U.S. law)?
