One more question,

What about seeking legal mediation between the ex, the Sm and myself? Is that worth trying before emergency temporary court orders, legal kidnapping threats etc.? Would my son be involved in that process?

I want to make this as easy as possible for him and my family.... And I don't want to wait weeks, or months for a resolution. Especially, considering that he has been left in her care. This really affects everyone in our lives, grandparents, aunts, uncles, friends, etc. I don't want a soap opera here.... but I want my son to live with one of his biological parents, preferably me, not an ex-step-mom.

mediation sounds like a great idea, I know in my state mediation is mandatory for all custody matters before it ever reaches the court room.

perhaps the court clerk at the courthouse could point you in the right direction.

personal opinion, I'd file for the emergency temp custody first, then sit down and mediate.
