School day parking ticket in NYC

Simple Question. Do camps have the same "School Day" status as schools with regards to parking at a school zone?

Long Story: I work at a school. In the summer, the office is open, but school is out. So, I parked my car in front of the school. Then some jerk from my job told a police officer that there was class that day. The camp schedualle is to include academic learning before the activities. To top it off, the officer wrote that in the ticket. The camp rents the space from the school.

I looked up sections 4-01 and 4-08 in the nyc laws and didn't find a definition for a school day.

The school zone is in effect any time the building is open EVEN IF STUDENTS ARE NOT PRESENT. Summer sessions count. You are guilty.

Whoops, I need to make myself clearer. The sign says, "No parking -- school days only". Implying that parking is permitted on a non-school day. So my original question stands. Anyone with an answer? I tried looking up the New York State' website, but I get an "internal error when I click on VAT"

You didn't get it, did you? Summer sessions ARE school days. You are guilty .. pay your ticket.

Let me reiterate to make myself clear to you.

"School days only" apply whenever the building is open. Even if the teachers are there working without students. Even for summer school or camp programs. If the building is open for any sort of business it is a "school day" as far as NYC is concerned.

Pay the fine.

Where exactly in the New York City Codes or State Codes would this be written? Please prove your advice. To help you prove yourself, I am leaving you the links to NY's laws.

New York City -- Title 34, Chapter 4 http://24.97.137.100/nyc/rcny/entered.htm

New York State -- VAT (Vehicle and Traffic), Article 32 http://public.leginfo.state.ny.us/menugetf.cgi?COMMONQUERY=LAWS

Thank You

Ron - I gotta admit - this one seems suspect - I'd also like to see your proof on this. "School Days" would imply that school is in session on that day.

You Are Guilty

As noted, "school day" = "any day school is open for any reason". However, if there are no students that day, you can try to get a letter from the principal stating so and submit that as your defense. Some ALJ's will accept this and dismiss/reduce the ticket (although most will not care :)).

Well, it looks like I will beat this ticket because, I just received a not guilty response on the same type and place of violation. This vehicle was not guilty because "Invalid days and/or hours in effect warrants dismissal"

But what I don't get is, what makes the sign invalid? It looks valid enough to me.

If you take a look at this page it states that "Parking is allowed in school zones when school is in recess. Individuals should contact specific schools to verify that they are in recess. " During the summer schools are technically in recess as defined by the school calendar - final day of classes is listed as the end of the school sessions for all students and the September start date is listed as the first day of sessions. Nowhere on this page does it mention anything about the school day being defined as a day during which the school is open for any reason. Besides, that wouldn't make much sense, now would it?

Since the thread was revived, it turns out that the sign was not invalid, but the police officers do not know how to write a "No Parking School-Day" ticket.
