I was involved in a front end collision. Police report places fault on other driver. Moderate damage to vehicle and some injuries sustained. If my Demand Letter goes unanswered or the offer is not what I expect who should I serve with the small claims court papers? The owner or the Insurance Co.? Can I serve the owner if the insurance co. is stalling on their offer or am I bound to negotiate only with them?
