The charge wasn't changed. Whoever input the summons in Albany put in the wrong charge - it's not uncommon. It will be amended in court if you point out the discrepancy to the judge.

The actual speed doesn't necessarily have to be noted on the summons. That will not get it dismissed in and of itself.
 
Well, you do have your citation right? It does seem to show a uncertain and possibly incompetant prosecution but now they seem to have changed the mistake charge to one they can attempt to prosecute.

I can email you some case law regarding the foundation for evidence for speed measurement in NY, perhaps that is a better defense strategy.
I dont think that they need a foundation in this system ...
