This is an unlawful detainer suit. At the trial, we entered into a Stipulation Agreement with the Tenant (UD-115). We were awarded the total costs and the Tenant was allowed to stay if he paid the total costs in an agreed to installment plan.

Judgement will be entered upon default of payment of the installment plan, and is set for 2 months later (the last payment date). We, the Tenant and the judge signed the agreement.

The Tenant did not even pay the 1st installment!! Right now we have a court date for 2 months later, and we want to evict him NOW for being noncompliant with the stipulated agreement. How can we request an earlier court date to show that the Tenant was noncompliant so we can get a judgement and possession asap?

Don't know, but my rule of thumb is to never negotiate or agree to let a tenant that I have filed against to stay. Sounds like the judge talked you into a bad deal.
