My husband had a dui in 2004. He passed away early 2005. His fine had not yet been paid in full. He was on a payment plan. Can the state garnish my tax refund for that amount still owed?
Yes, it was his debt, and now it's his estate's debt. Assuming there is an estate, it is liable to pay. Of course, if he died penniless, then there's nothing to do.
As far as the tax return goes, was it a joint return? If so, it becomes part of the estate mentioned above and subject to collections.
