What is the name of your state? Missouri

I am disabled, on SSI. That is all the income I have. There is no monies, except direct deposit, of my SSI check, that goes into my account, I have no other money. I own a house, acre, and a 1992 car.

The only debt I have is a credit card. I had always keep this paid, untill last fall, while I was waiting on my disabily to go through I had no income. the debt was appro $3,500.00. Now its appro $6,000.00.

Credit card turned, this debt over to a collection agency. I called them, appro 3 months ago,( of course, dumb me, I didn't ask, who I was talking to) anyway, she said just, send in a copy of your income and whatever amount you can pay. So I was sending them in like $20.00 a month. Did this for last 3 months.

Then I got a summons to appear in court, from the Credit Card Co. I called the collection agency, and asked them about why I got a summons to appear in court, when I was paying and they said, well they weren't happy with that amount and they would have had to have $1.40.00. @ month. I get less than $600.00 @ month to live on. That is all I have, to keep everything maintained, buy food, gas, etc.

My question is ( and I know , only the judge knows for sure what he will decide) but what is likely to happen? Will they put a lien on my property. Force me to make a big payment. add alot more lawyer fees, like they allready have? What can they do to me if I can't make this payment?

I have never, had to go to court for anything like this before. So I am really scared.

ABSOLUTELY DO NOT CALL THIS SPAMMER!

You have options. And there are things you must do.

You have to go to court.
When you go to court bring copies of the checks for the payment you have been making.
You are going to lose in court, which means they will win a judgement.

You, however, are judgement proof. They will place lien on your home so you can't sell it until the lien is cleared. They cannot attach your SSI and both your home and car may be protected -- you will have to check into Missouri law.

If you are in southwest Missouri, I have a friend who practices in Branson that may be able to assist you at little or no cost. He occasionally takes pro-bono cases.

I live close to Rolla Mo, more south central, missouri I believe. Do you think that would be to far for your friend? The court date is this coming Thursday.
From what I understand, this credit card co. does not have to have a lawyer there, they do it all on the phone.

Would there be any chance, that if I asked the judge, that he might drop some of the late interest fees or the $642.00 Adjust Atty Fees.

If I could just get this down, to were I could make a payment, and get this paid off.

That would be far. It is more than a three-hour drive from Branson to Rolla. Chris used to be with JAG at Fort Leonard Wood.

Judges in that area tend to defer to locals over out-of-the area people and generally don't like people that can't be bothered to appear in person.

If you go to court with copies of everything, you stand a good chance at coming out ok -- there will still be a judgement, but make sure you ask that payments be made through the court.

Thank you, for all your responses, I appreciate, all the advice and help I can get.
What benefit or advantage, would it be to me to ask that payments, be made through the courts?
