"06-12487 MVC and Impaired Operation of Motor Vehicle.

On Sunday 06 August 2006 at approximately 10:05 p.m. the accused was operating his motor vehicle and travelling north on Simcoe County Road #4 near the 10th Sideroad in Bradford West Gwillimbury.

A 2nd vehicle was also travelling north on Simcoe County Rd. #4 when the accused's vehicle approached him from behind. The accused in his drunken state was unable to judge how fast he was approaching the 2nd vehicle travelling in front of him. The accused crashed into the 2nd vehicle, from behind, while the 2nd vehicle was travelling at approximately 80 Km/h. The accused's vehicle then was lodged under the 2nd vehicle and the two proceeded north swerving wildly, sometimes into oncoming traffic. As a result of the accident only the accused was injured with scrapes to his forehead, from his head striking the windshield. The two vehicles managed to make it to the shoulder of the roadway and the driver of the 2nd vehicle observed that the accused was intoxicated. The accused began crying and apologizing and vomited as the victim waited for the arrival of police.

When Police arrived at the MVC scene the accused was arrested and taken to the Police Station for breath tests. The accused registered readings in excess of double the legal limit.

The accused, a 21 year old Innisfil man, faces charges of Impaired Operation, Excess Alcohol and Highway Traffic Act offences. He will be appearing in Bradford Court in September. "


my court date is getting pretty close, its the 28th of this month. Do you guys think its in my best interest to invest the $5000 dollars to the most favorable lawyer i have talked to? Or should i just go in thinking theres no way out of this?

I think it's important that you guy's know iv learned my lesson from this and i am very glad nobody was hurt. Havent drank since and dont plan on it in the future. I dont want you guy's to think that this is some drunk that want's out of trouble. My license was crucial for me as i was driving for a living. I havent had my license for about two months or so now and i absolutely HATE it.

So the advice im asking for is should i invest the $5000 or use the free duty councel and hope for the best?

I think it's pretty obvious that im guilty but im willing to do anything not to have my license suspended.

Any suggestions would be great.

all im looking for is some suggestions about this :cool:
I suggest you look harder for a canadian law forum - or maybe, if you really are so worried, shell out a few canadian bucks for a canadian lawyer (or whatever they are called up there).
People in a US Law forum just don't know the canadian laws - sorry.

my search for a Canadian law forum shall continue. I have asked three lawyer's so far and they think they have a case. I myself think they want my money. The next time i talk with the lawyer i want i gotta give him $2500. I guess ill sleep on it and wait till i get my disclosure papers.

Since this is in Canada, I have no idea what your DUI laws are like. But if you were in the US, I would suggest you don't show up in court without a lawyer.
