Pressing Charges

What is the name of your state? GA

I purchased a computer from Ebay and have not received any communication to date. I contacted some other individuals that bought from the same individual and they have not received their computers nor any communication. I am going through my credit card company to retreive my funds but what can I do about pressing charges against this individual? He lives in Pennsylvania and I in Georgia.

If you get your money back, there is nothing more you can do, you have been made whole again. If you don't get your money back, you can sue the individual in his home state. It would be highly unlikely any criminal charges could be pressed against the person, you will be told it is a civil matter and it is up to you to seek a remedy through the courts.

Where is he in Pennsylvania?

Hope you have exact contact information. You can get that on Ebay assuming it's legit.

First, call the police department of where he lives. Chances are others have done so and you can add to their complaint.

The police can take this to their District Attorney to see if they will file theft carges or you can file with the local magistrate yourself(up to an $8000 claim). Problem with that is that you will have to show up to file and to present evidence at the hearing.

Actually it is a criminal matter -- theft by deception at the very least and more charges could be added depending on the amount of money. A gentleman in Ohio auctioned off tickets to a major sporting event and pocketed the money. Even though he made restitution, he was still arrested, tried and convicted.
