I am being sued for an unpaid medical bill. I wrote to the court requesting a postponement of my orignal court date because I had to contact my insurance company to obtain records. The Judge give me a one month extension. Its been 3 weeks and yesterday I received the paperwork that I requested from my insurance company. The kicker is... they did not send what I requested. I called and they said I must again request in writing the documents that I want. I faxed the request today and asked that the information be returned by fax as quickly as possible as it was need for legal purposes. My next scheduled court date is 8 days away. I am afraid I wont have the necessary documents by then to prove my case. I do not have a lawyer and the court is 4 hours from where I now live. Would I be wrong to call the court, or send another request by writing, explaining that I have not yet received the necessary documents? I dont want the Judge to think I am trying to get out of coming to court, but since it is 4 hours away, I would prefer to make the trip once when I have all the necessary documents to prove my case. Thank you in advance for any replies. What is the name of your state?

Can you? Of course. Just be sure to send a copy of your request to the plaintiff or plaintiff's lawyer, if they have one.

Now whether the judge will actually do what you request is another story entirely. They are under no obligation to - most judges do require personal appearances to request adjournments, so don't get your hopes up too far.

I agree; you need to be talking to the plaintiff's lawyer as soon as possible.
