Statute of Frauds with Paypal?

First post here. Please take an easy senior posters!!:) Thanks for your help though!

I have the typical Chargeback story with Paypal. Sold and sent and verified item on ebay. Buyer paid by Paypal. Paypal found case in my favor, however American Express did not. Submitted all evidence needed in reference to verifying item was received and as described. I was also notified by Paypal that there was no guarantee that evidence would be submitted. I then requested the credit card companies contact info. So I may be sure that evidence was submitted. Paypal refused. I had no success at fighting the chargeback. I still have not received my item back and I get no help from authorities. This is a civil matter I understand. The problem is I don’t have the money to give to IC systems (collection agency) to prevent damage to my credit until this is resolved.

After Paypal withdrew all funds available there was till a $3000 balance due to Paypal.

So my question is has anyone ever used Statute of Frauds against debt from Paypal or Ebay. Their defense is I clicked on user agreement. However I never signed a user agreement.What is the name of your state?

Your clicking constituted acceptance of the user agreement.

I had a similar problem with Paypal (although I was on the opposite end) and in the end the box I clicked acted as a signature and I could do nothing about the money I lost. I even looked into starting a class action suit against Paypal, but apparently you release them of all liability when you click that box. So sorry, I know what it feels like to be scewed over by paypal!

Let me rephrase your comment into the correct legal context.

I agreed to the terms and conditions of Paypal without completely reading and understand the legally binding terms and conditions. I was ripped off by a unscrupulous buyer/seller and because going after them is difficult, I have chosen to blame Paypal because I was ignorant of how escrow services actually operate. I am most likely also guilty of failing to keep proper documentation of the transaction that resulted in my disagreement with Paypal. I have now learned that conducting business over the internet has it's pitfalls but because I am hard headed and don't have a clue about real world financial dealings, I will continue to rant and rave like the ignoramous that I am and continue to blame Paypal for my ignorance.
I will add that as an Ebay seller with a rating of over 1000, with 100% feedback, I have had 14 chargeback through Paypal and have won all but one. The one I lost was a buyer from California that had used a stolen credit card.

So sorry, I know what it feels like to be scewed over by paypal!
I guess you can see it that way, especially if you don't know and don't care the devil-in-the-
details of what it's like being on the other side of the fence. Many people typically have that
viewpoint due to: a) unrealistic expectations, and b) not knowing your rights (if any) when
dealing with a service provider.

Seems like racer 22 has a big head! How many times have you cut and paste that response. You as an "experienced" ebayer should know that it depends on the credit card company. I don’t need to sell 1000+++ items to make a profit on ebay. For you to say or use a quote that suggest I was negligent and suggest that I am ignorant is an act of ignorance itself. Hey, if it makes you feel better about yourself, go ahead and make your empty comments over the internet tough guy. This is just a guess, you work for paypal/ebay, you have thick glasses and arms that look like you have been sitting behind that computer all your life. That or you are a self proclaimed entre-manure genius. Get a life!:confused:

Are you saying that he took your quote out of context? I've never had a problem with ebay or paypal either. I filed 1 legitimate chargeback, and since the seller did not respond at all, I won by default. Had the seller responded, I might have needed to supply additional proof. But, since I do keep great records, it wouldn't have been a problem.

I'm not a guy.
I'm not tough.
I don't work for paypal or ebay.
I don't sell 1000+ items.

First, it's racer72. Second, I don't cut and paste anything, I have the knowledge to type thoughts as they come to my head. I even did the coding myself. I don't work for Paypal or Ebay, I work for a large aerospace company located in Seattle, I perform functional testing of new aircraft. I also am a licensed paralegal and to keep me occupied on weekends, I own a small limosine service. I do wear glasses, but they are hardly thick. I also enjoy power lifting and mountain biking. For many years I drove race car here in the Northwest, for a couple years at a NASCAR touring car level. My question to you, troll, why are you so upset? My post was not directed at you in any way. Perhaps it hit a little too close to home and that was the best you could do as a response? Rather pathetic in my book. As you can see by my post count, I have been around these forums for quite a while and plan to be in the future. Dealing with trolls like yourself is what keeps me coming back. If you want to get into a pissing contest, bring it on. I have taken on a whole lot worse than you.
