I have a hearing coming next month, and I am a little confuse about the difference between a hearing and a trial? Is only in a trial where judges make rulings for custody cases or can they make them on hearings too? I just know what to expect from the hearing.

That depends on what the hearing is for. Is it a hearing for temporary orders? A hearing to show cause? The possibilities are endless.

The hearing is for disestablishing a paternity. What I would really like to know is if after this hearing, should I expect to go to trial

Is either party contesting the disestablishment of paternity? Has it already been proven via a court ordered DNA test?

The legal father is contesting the disestablishment, it hasn't been proven by a DNA yet.

Then you can expect the case to go to trial. It certainly won't be resolved in the first hearing.

I am the mother, the legal father singed an AOP more than 3 years ago, I am trying to disestablish his paternity, when he signed the AOP we didn't know he wasn't the bio dad.

Hmmm. You WANTED him to be legal father and YOU had him establish legal paternity. He could not have done so without YOU having him sign. So, YOU must have told him he was the father.

She did, but she has not seen him but twice in over a year, now she calls my boyfriend dad.

You may want to find a good attorney ASAP. The judge is NOT going to be amused with the game of "musical daddies" that you have chosen to play with a CHILD. Honestly, you're doing nothing but wasting your money and the courts time.

Unless the REAL biological father wishes to establish paternity, you don't have a case.

Wonder how enthused these musical daddy players would be if they had to pay back every penny of CS in the event they turned out to have scammed a guy about paternity at the beginning.

OMG! Too bad the judge won't take this kid COMPLETELY out of her custody! Talk about musical daddys.

THat's three for this kid. Wonder how many daddys each of her other kids represent "Let's see, there's the daddy who gave the sperm, the daddy I had sign the paternity affidavit, the daddy I have my kid calling daddy**************."

You will have a hearing...not a trial. IF, after the hearing the issue(s) of Paternity are not settled, it may go to trial if the other side wishes to further pursue the issue. If Custody is contested...the issue will go to mediation & you can both work on trying to come to an agreement re; custody/visitation. I'll tell you right now that CA courts/mediators/judges are not likely to think it's 'cute' that a 3 yr. old keeps having their 'daddy' switched on them. Consistency & Continuity is very important in a child's life.
