I had been purchasing compact discs from a seller that I used to deal with on Ebay. After several purchases he then emailed me to say that he was no longer selling on Ebay but that we could still do business through Paypal. To gain my trust he shipped a couple of orders to me before I paid and then I would pay him after I'd received my items. Several times he would take very long to deliver the goods but I would eventually receive what I'd ordered. Recently in August I placed an order from him that was a little larger than usual and he asked if I would pay him up front which I did. After one month I emailed him and he said that he would ship in a couple of days. This went on for a few months and a times he refused to reply to my emails. I retreived a paypal receipt that had his phone number on it for customer service so I called long distance and left a message on the answering service. He then replied saying that he had death in the family and was having financial troubles. So having compassion I stopped pressing the issue. After about another month I asked him to give me a commited time for delivery of my cds. He said that it would arrive in the next week. That was six weeks ago and I tried to file a complaint through paypal and was told that the time had expired to file a claim. I've since tried to make contact with the seller and now I'm being ignored. I'd paid him $84.00 and suspect that I'm not the only one who has been taken by this guy. He lives in Oregon. Is it worth filing a small claims case against him or do you think I should take the lost? I reall rather have my money refunded.What is the name of your state?What is the name of your state?
