What is the name of your state? vt what happens if someone is behind in child support and unemployed and ordered to find work by the court and threatened with contempt for willfully not working, then 2 weeks later finds out that they need surgery and cannot work for a few months? Just curious. Thanks

For your friends sake I hope the injury wasn't caused by a "playing" accident...The judge probably wouldn't be very happy with someone who went "rollerblading" instead of working… injured themselves, and would then like to use the injury that resulted as an excuse to delay child support...

For example: Fractured heel or something of that nature on a factory worker -- they can't stand for a few months while it is heeling yet their job requires them to stand.
It is not just the surgery but also the job they have. And it is not as easy as saying get a new job because child support is not that forgiving. They would have to find a new job paying the equivalent of what they are earning with the benefits they currently have that would hire them after a surgery that leaves them partially unable to function in some way.

No offense, but, they don't have a job, and apparently haven't for a while. They have been ordered to get one. I don't think that finding an equivalent one is really an issue.

Well I have not been following the several threads posted this OP. I was just answering your question which seemed rather general -- hence why I answered the way I did. As for not imagining anything like a broken bone -- a friend of mine had that problem. She fractured her foot and they tried to let it heal by itself (well casted) and it didn't so then surgery was scheduled after the foot had been fractured for a few months. So it is possible that someone can "just found out" about surgery for a broken bone.

I would think cancer would qualify as a good excuse...It would also be wise to get a letter from a doctor certifying the condition and the amount of time she is going to need to recoupe...It may seem sick that someone would fake such an illness but Judges see everything...

I would have to agree. That would certainly seem like a medical emergency.

So what should they do? Let the courts know, the child support office? How do you deal with this if already in contempt. A doctor can verify everything.

yes and yes. They need to contact both the court and child support, for instructions if nothing else. Was a time frame given for this person to find a job? Is there another court date pending?
