Indiana- I have a relative that was accused of a Class A, B, and C felony in the month of September 2006. We found out about a warrant issued through our local newspaper which included a name, picture, and an article that accused him of some very malicious crimes. After reading this we immediately had to borrow thousands of dollars so that we could hire an attorney. After obtaining legal counsel we were informed that the crimes that he was being accused of took place somewhere around April or May 2006. Immediatley after hiring the lawyer we turned him in an he was just released as of yesterday November 30, 2006. The reason for his release we were told was because of insuffiecient evidence. Usually cases like these are followed by our local newspaper so I'm sure in a day or two he will appear in the paper again because he was released and charges were dropped. To make matters worst he is a very ill person that has an enlarged heart and has to take 10-15 meds a day and has to be on 24 hour oxygen. Because of this he was held in a medical ward on 23 hour lockdown in a cell watched by a camera with no windows until yesterday. He was also on dissability and this has to be fixed as well. We live in a fairly small city and it has a very high crime rate. The actions of the local police and newspaper has forced my family member into a position where he has to find somewhere else to live because of these accusations. I'm not sure if this is slander on the part of the newspaper but I'm pretty sure that the local police should be responsible for their actions. We don't have much money so I figure it will be hard to find representation. After discussing the issue with my relative he is very distrout from the whole thing and we both agree that it's really not about the money it's more about making sure you have the right person before dragging there name through the mud. What should we do? What type of actions and damages should we seek?
