Either way, that gaping hole needs to sh*t up since she is/was a big part of pain and problems in her kids life. And if she doesn't like the US, there are plenty of other countries she can move to.

I believe in PA you have to pay like a $25 fee to get your license back after it has been suspended. Maybe they could make that fine a lot larger if the reason for the suspension was for nonpayment of court ordered child support. And the amount over $25 (or whatever the fee is in other states) could go to the person that was owed child support, IDO if that's possible. It just seems too easy to get your license back so why would they bother suspending them in the first place for noncompliance?

I was always under the impression that if you have not paid your CS and your license is suspended, you could not get it back until you are paid up. Is this not correct???

Numerous posters including myself have told you that it isnt likely you will get anything. Place issue in Child support services hands and just drop it! Its not worth the headache and frustration (I know I have been there) This isnt about a failed system! Just a few years ago NOTHING happened to deadbeat parents! Now their license is suspended jail is sometimes an issue etc. The system is doing what it can. Putting parents in jail solves nothing and makes payment even tougher. The system has not failed. Its growing and suffering growing pains. Your Ex hired an Attorney who "justly" used teh Law in his favor so can you! I realize its not fair but its life too. If caring for the children is a problem go on some sort of assistance then the government will go after him! reduce your home cost fewer nights out fewer movie rentals etc. Having been there I feel for you but I urge you to just let what happens happen. In the long run its your Ex who will suffer not you or your children! The system is what it is exercise your right to vote if unhappy with how things work thats how you change it! In meantime give your kids a hug!

Boy, people can be brutal on this forum and it is my first day here. I agree with Peanut, the justice system is screwed up, people fall through the cracks. Sometimes it works, it depends on the mood of the judge, the way you present your case, it is a nightmare. I have been back and forth with my ex for the last 7 years. The first 5 of our divorce we were friends, until he married a very controling person. Two controling people to not mix. I have actually just filed a no contact order on the wife and will win that( I have tapes and 100's of letters). Yes I did let her know she was taped, but she still swears at me on the phone and hangs up. 7 years of letters and I am fed up. It impedes my ex and I being about to get this boy better. I then tried with out filing on an amount for child support, a less than 100 dollar increase. He refused and we are now fighting. He just filed a contempt charge against me because his 13 year old child doesn't want to go over there (for sleepovers). (There are past abuse charges against his wife, where she has admitted to some). So he is still suffering some trauma of that. So I am prepared to fight to the death and debt. Yes my son sees a phyciatrist, that tells him, he can decide what he wants to do, so here I am being sued for it. Keep in mind we in the beginning at 50/50 split, boy do I miss that. But I have to be on my childs side, since that are what parents are for.

Sorry for the ramble when I was going to tell Peanut to keep fighting, it will turn out eventually. I am a firm believer of "What comes around, goes around".

You are jumping on the bandwagon of dissing the system you have helped create, and at the same time confident that you will win your case, so how exactly have YOU been a victim of a "screwed up" system??? Contradiction is always an unreliable quality in a person.

You're kidding, right?? The judges ARE the system - their mood is what determines the outcome of the trial.

What kind of moronic statement is that!? The Law decides the outcome not the judges mood. The judges mood may decide if your held in contempt or not. You have been told repeatedly (and failed to listen) Your best option is to work within the system you despise so much. Its this system that will decide outcome and the laws pertaining to it!
 
The judges, though, don't make the laws. Are there laws in your state that the judge can put them in jail or suspend their license?
Yes, in MD the law says that they can be found in contempt and put into jail - Child Support Enforcement Agency has CANCELLED 3 Contempt Hearings out of spite because the lawyer handling my case got vindictive when I notified the Governor of Maryland that he (the lawyer for CSE) was repeatedly reinstating my EX's suspended license. There is no organization that governs CSE in MD - they do their own thing and I met one woman who told me her EX owed her almost $50,000 and this same CSE lawyer did NOTHING to her husband when he came to the CSE review before the Contempt Hearing - her EX gave CSE $30 towards the child support arrearage, and the lawyer cancelled the Contempt Hearing. Believe me, we're not making this stuff up.

Yes, that is the law. However, this is where the Justice System and Child Support Enforcement fail - they keep suspending and reinstating licenses without getting child support - or getting such a small amount, then they cancel the Contempt Hearing. It is insane.

Beg to differ - the LAW has rules and guidelines - the Judges pick and choose which ones they wish to enforce. The laws do not run around making decisions - the Judges do - again - the Judges are the system - not the laws. Another case in point I will re-iterate in my case - there is $258,000 sitting in court Escrow that has had several liens put on it by MY attorneys' insistence to the CSE lawyer - he wouldn't have filed independently - he just wants to shuffle paper. I have judgements that should seize that money for the arrearage, but it hasn't been seized nor paid - and yet, other judgement creditors of my EX's were able to file motions and obtain judgements against that money in the court Escrow - and the court moved right away to pay out the money to them - hmmmmmmmmmm******************************************......so the SYSTEM has decided not to pay the child support arrearage**************....hmmmmmmmmmmmmmmm

All 3 attorneys who have been representing me throughout all of this nonsense have said repeatedly to me, that in each of their 30 yrs of their legal careers, they have never seen a case that has been so battered and tossed around and unjustice as mine has been. That tells me something about the SYSTEM.
