Hello, I am very worried about my situation and I need some advice. I moved into a USDA rural development apartment around this time last year, it is a federally subsidized apartment. which requires that you verify your income every time the term of your lease is nearing an end, this means they take tax return statements, bank statements, or written verification by an employer. since I have not started in on my taxes I do not have any tax forms to present, so I have to give them the bank statements and written verification from an employer. I am what you would consider a private contractor which means that I take work from an outside agency which happens to be located in a different state, this caused plenty of confusion with the first apartment manager, to which she contacted the third party whom i work for with an inquiry to my income. This apartment manager recently transfered out to a different apartment complex.

Please keep in mind that this is my first apartment, and first job as a matter of fact. I was highly confused by the certification process to begin with and I pretty much went with the flow and agreed with what the manager was doing. I did not believe they would be contacting them every year, but this year when I had explained my situation to the new manager we ended up contacting the people whom i take work for again, what worries me is that this third party whom I work for might have misrepresented my income, as it is highly unpredictable how much i make a year, they pretty much make an estimate of what i make, as I do not get a set amount on every check each month as a normal job would provide. According to the rural housing service this may be illegal.

Here is the exact clause:

_Whoever, in any matter within the jurisdiction of any department or agency of the United States knowingly and willfully falsifies, conceals or covers up by any trick, scheme, or device a material fact or makes any false, fictitious or fraudulent statements or representations, or makes or uses any false writing or document knowing the same to contain any false, fictitious or fraudulent statement or entry shall be fined under this title or imprisoned for not more than five years or both._​

Well , who might have misrepresented your income , you or the third Party ?

If not you , then you wouldn't have intentionally deceived anyone .

When you are sure of your tax status ( as in paid preparer documents ) , submit them to the Fed. Agency for assistance .

If there's a difference , make sure you have the funds to pay it , if owed .

First off thank you for your response. They had faxed the document directly to the third party and they filled it out, I didn't make any estimation on what I had made this year on any forms myself, although they informed me of the amount they put down on the paper after they did so.

I still have not received any word back about this from the apt manager, any reason to be concerned? If I was denied, or if they decided to try making me pay back rent does anyone think they would hold off on informing me of this until the first of the month? my lease expires on 1/13/2006 and i've called about the certification each week since it happened only to be told it's taking 'longer than expected'.

I should also note that I probably should have considered myself self employed.
