What is the name of your state? New York.


I had been selling for about a year on ebay some academic software from a large vendor. The way that I was going about selling it was logging into an account that was initially visible for everyone to see/know the details of username/password. This is just on their website and they freely gave out this information.

Months past, I continued ordering. I noticed they took that site down where they listed how to access the special website to receive lower prices.

I received a call from this company and they are threatening legal action for unauthorized use and lost profits, etc. Any thoughts?

The thing is, access to this website to purchase this software was freely available for anyone to see.

I paid for these items with my money. There was nothing I had to sign saying I would not resell, etc.

since the box was not opened, the "shrinkwrap" license is, from my understanding, not in force. if the license even says anything about reselling...
