What is the name of your state? Texas
OK, this may seem kind of a weird question. My XH is working for a friend and getting paid "under the table" to evade CS collections. This has been going on for almost a year and he and his spouse are living in a nice house and driving nice cars. I'm pretty sure everything is in her name, since the OAG can't find any $ lying around to seize. The OAG has contacted the employer friend, in which he denies that my XH works there (My XH reported to the court in a modification for CS this employer and address). They have since moved again. I know the city he lives in because my kids tell me, but don't know the address, and I'm not about to ask my kids for it or get them involved in this. Anyway, the OAG says that they cannot locate him. I know they publish pictures of CS evaders. What if I placed an ad in that city's newspaper with his picture and how much he owes in back CS?
Can I get into trouble for doing that? I know the OAG has thousands of evaders, they can't publish them all. This is public information, isn't it? My DH is worried I would be sued for "defamation". But how can you be sued for something that is factual?

Is it unpaid CS that was ordered, or is this CS you presume he would owe if he earned what you presume he earned.

Is the wife also working, or has premarital assets? If so, why do you presume that having a nice house or car is the result of his, rather than her, income? I am in sales, and get a nice auto allowance from my employer because I drive so much for my job, as an example. My car in no way reflects my husband's income. WE also own a very nice house- but have tiny payments, because of equity from a prior home I owned. I am just pointing out that one can't presume that a person who drives a nice car or has a home in a pricey neighborhood actually has a big income. I sold real estate for years, and you'd be amazed at how many people in expensive homes have tiny mortgages and correspondingly tiny house payments.

No information is presumed. Factual information provided by OAG. Really want to know if this is legal or if anyone has done this before and their results. thank you.

Sorry, but those accusations were not "helpful". This is for my children, whom I love and will fight for until there is nothing left of me. I cannot agree with coming to the defense of those who refuse to acknowledge their responsibilities to thier offspring.

I didn't see any accusations. NW simply asked if it was ordered CS or CS you think he should be paying. She also went on to explain her situation and how you shouldn't PRESUME that it's from your ex's income and not his wifes. Not one person on this site is going to defend a deadbeat.

Belize already answered that in his first post. Learn to take what you need and disregard the rest if you don't like it.

Oh well, you guys win, I give up. These threads never stay on topic and always evolve into something else unfortunately. :( I'd still like to know if anyone has every done this on their own, but its probably to far down into the thread now to ever get an answer :( . Hopefully, someone will get some use out of the idea, and I hope it helps them.
