I live in Texas. I got on ebay and I bid on a ps3 and won. Now I don't won't to buy it cause I have been told that some ps3 are not being sent to buyers. Also some are being sent and are not working. I don't want to risk it. So now the seller is saying that if I don't buy the ps3, he is going to sue me. Can he sue me or what can I do.

Of course he can sue you. The reasons you give are not legal reasons for backing out of the agreement.

Use PayPal to protect yourself if he doesn't send it to you.

If the PS3 isn't running properly, it is covered under warranty.

Word of advice from an Ex-scammer DON'T USE PAYPAL.
