What is the name of your state? CA
My brother & I are the only children of bio-dad. He is apparently terminally ill. Our stepmother never had kids. I was sexually abused by bio-dad & he was arrested & convicted for the crime. Because of this, I have cut all ties with him & stepmother. Will I & my brother have any rights to his estate when he dies? We are pretty sure he will leave everything to stepmother and she will make sure we get nothing.
It's too late to sue him for my abuse, since it happened so long ago.
Any information will be appreciated.

So what is this? A post about abuse and suing? An estate question? Or did your therapist tell you to come here and vent?

If he dies with a will, it will depend on the terms of the will.
If he dies without a will, then you are (based on the facts presented) entitled to a portion of his remaining estate.
