I went a few dollars below my balance on my checking account, which I admit was my fault. I bought three things with my debit card and I got overcharge fees of $19 for each item I purchased for a total of $57 in overcharge fees.
So I called my bank asking if I could have the overcharge fees removed and the associate said that you have a 24-hour grace period to balance your account and the fees will be removed. But the fees remained.
So I called two days later and spoke to a supervisor who said there is no such 24-hour policy and the fees would remain. I asked to have my account closed with BoA and they refused because I was below balance. Well, I'm below balance because of the overcharges they said would be removed! I also asked for the name of the associate I spoke to two nights earlier and they said they knew who it was but refused for security reasons.
I'm thinking of taking them to small claims court on the grounds that I was lied to and their refusal to close my account. It's not about the money so much its the principal. Do I have any chance of winning?
