School Contract

Greetings

I have a 3 year old and we recently moved so we had to choose a new school (montessori) for him to attend. Most schools are full so after a lot of searching we found one that we thought would be a good fit.

The first 2 weeks went well and at that point I signed a contract and paid 2 months ($1800) tuition.

Right about at that same time my son started being very unhappy to go to school (not like him - he was great at his previous school) was starting to behave very badly at home and also started saying some very bad things that he was obviously picking up from school since that is the only place that he goes that my wife or I are not present.

When I would drop him off at school for the next 2 weeks he would not want to go in, the teacher would run in and out a bit, but never really stopped to offer assistance, none of the kids were saying hello, etc....

Just a bad situation. On the last day I took him to school I asked the teacher how he was doing and she said fine. From knowing my son, I can't see how his behavior at home was changing for the worse but he was "fine" when he was at school.

It appeared to me that the teacher was not attentive enough to be able to make a comfortable environment for my child.

We did not go back and my son has since started at another school and is doing great. The problem is my contract says I am responsible for tutition no matter what. I still have to pay even though he is not going.

We can barely afford one school and paying double would be a huge burden.

Summary:
Nov 3: Started new school
Nov: 26: signed contract and paid 2 months ($1800)
Dec 1: Really started to notice we had a problem.
Dec 12: Done with school

Do I have any recourse?

Yes, pay your debts. Or, pray there is an option to cancel IN the contract.

So even though they did not keep up their end of the "agreement" - to provide my son with a positive nurturing atmosphere that he can thrive in - I am just out of luck?

You have yet to report that anything was amiss at the school, other than your son's reaction to it.

OK, I will stop with the formalities. I think the teacher sucked. There was also an assistant and I think she sucked. My son was obviously getting teased and the teachers were un-aware and looked kind of bored, honestly. The kids looked bored also. Not a Montessori environment at all.

Why do I have to pay for that?

Well, maybe the powers that be in this forum will opine that I do have to pay for that, but my son does not have to be subjected to that.

Contract Law 101
Well, maybe the powers that be in this forum will opine that I do have to pay for that, but my son does not have to be subjected to that.
Which he is not now. But, as told to you, that does not obviate your legal responsibility.
