I opened a credit account with a retailer. They sent the bills to an incomplete address and I never got the first couple of bills. They've reported the default to a credit agency. My opinion is that it was their fault and therefore they should remove the item from my credit report. They claim that since they didn't get the bills back by return mail they have the right to "assume" that I got the bills and just didn't pay. Who's right? Can I compel them to remove the unfavorable item from my credit report? How?

And I guess you just ignored the 'no bill' issue, huh??
What did they say when you contacted THEM asking for a bill after about 45 days of no bills??

Based on your post... they are correct in that you didn't pay as promised. That is all that the credit report has to do... accurately reflect your payment history.

Can I compel them to remove the unfavorable item from my credit report?
No. As noted above, they are only required to ACCURATELY report your history.
