My other post was closed and I would like to hear some more viewpoints. My question is regarding rent money and child support calculation. My parents have been paying my rent directly to my landlord. I do not work and am on full disablility. Is this money something that could be counted towards my gross income for child support calculation purposes?

Yes, it can and should be counted as income.

You were given the proper legal advice in the previous thread and it has run its' course. That's why it was closed by the Admin. As was told to you by Ceara...I told you in the other thread, as did others...it would constitute as a recurring gift and can be counted. You should have disclosed this in the support hearing as when you are in a support hearing and/or filling out the paperwork, you are essentially "under oath" and if it's determined that you didn't disclose this, it could come back to bite you.

Since you are fully disabled, have you considered rental assistance benefits? That would NOT be counted as income for you, unlike the money your parents pay towards your rent.

My advise is to get a consult with a local attorney to get that question answered. I disagree with the other posters. Therefore, your best bet is to get it answered by someone who practices in the court where your case will be heard.

Advising her to see an attorney based on the fact that YOU happen to disagree with the actual LAW is a tad egotistical, don't you think?

And HYPOCRITICAL as well since she enjoys arguing with ACTUAL practicing attorneys. Which she is not. Perhaps we should start telling people to see actual tax professionals whenever she gives tax advice. :rolleyes:

The actual statute was posted WORD FOR WORD on the other thread. Recurring gifts are listed under the list of items that count as income. I don't see how there could be any confusion concerning the matter. If the OP went to apply for government assistance, the money would be counted as income as well. It's no different as far as CS is concerned.
