Someone threatening to sue me for slander on Ebay

I bought something on ebay and it wasn't nearly what was pictured/described and the seller refuses to give me a complete refund. He insists he has the right to keep $78 of mine (even though he incorrectly described the item). I want all my money back, its not my fault so I left him negative feedback stating " he's a scam artist and buyer beware". He replied with this "This communication is directed to the Ebay user -------and square trade. Upon noticing this user's feedback we immediately proceeded to call our attorney.we require immediately the above user's contact information and full legal name. In 72 !
hours we are beginning legal action against this user. The above user has broken the terms of service and sale that are applied to our auctions and Ebay's rules and guidelines that have been set for internet transactions. We will be pursuing lost revenue as a result of this users grossly negligent libel/slander feedback misuse. The user can avoid legal action from commencing in 72 hours by agreeing to removal of feedback.We are not able to sell goods until this user removed the libel comments and will seek $3000.00 per day in damages.WE OFFERED THE USER A REFUND OR EXCHANGE AND BOTH OFFERS HAVE BEEN MEET WITH INTERNET RAGE,THREATS AND MALICE. POLICE AND ATTORNEY AND EBAY ADVISED OF THREATS. EBAY TOLD US TO REPLY NO-MORE."

okay, assuming your facts are correct -

you bid and won (or buy-it-now) an item.

Paid for item, and shipping on item (or free shipping)

Item receive not item purchased

not offered FULL refund

you didn't say if he offered an exchange

you left neg. feedback which stated You stated "he's a scam artist, buyer beware"

... some questions these kind folks are going to ask will be ...

How did you pay for the item?
Have you filed a claim with E-Bay?
If you used PayPal (or Visa, or Mastercard) have filed a claim with them?
what other measures have you taken to object to this transaction other than leaving the negative feedback.
Did he in fact offer an exchange?
How much did you spend, and what percentage of that is $78 (they may not ask that, but be ready to answer it)
what was the item you bid on, and what did you receive.

These guys like to be armed with knowledge before they start dishing out advice, they don't want people going into court half ****ed because they advice they received was due to inaccurate information.

I am always amazed at the ignorance of e-bay users. The $3,000 a day is because each and every day you leave this up the attorney will file a separate and distince action. They most likely won't be able to collect on each one, but on the first you I wouldn't bet the farm.

Remove it or face the penalty for your own ignorance.

BB & SJ - I'm gonna question you on this one - "scam artist" hardly rises to the level of defamation. It is way to vague and represents the OPINION of the OP. "Buyer Beware" is good advice no matter what the situation...

I am an eBay seller. You don't have to give in to the threat because it is empty.
feedback is an opinon of the transaction as long as you conduct yourself in an
ethical manner let him sue. It won't hold up anyways. Even if it did $78 transaction is probably a small claim court case and small claim only honor actual lose not potential lost.

You should see it from the half full perspective. You are out of $78 already but now the seller want to
get the negative remove. repond back to square trade with comment like make it right and I will remove etc. Never use negative to black mail the seller in giving in but you certainly can ask the seller to change your mind with the excellent customer service he/she is going to offer you. This is your opportunity to get all or part of the $78 back.
