Time Limit for Appeals

What is the name of your state? Florida

My insurance certificate states that my insurance company must respond to appeals within 90 days. It has now been over 120 says since I filed my appeal and the insurance company has not responded. I sent the company 5 e-mails during that period. Yesterday, I finally broke down and paid for an international phone call (I live overseas). The company claims they never received any of my e-mails even though they confirm the address is correct.

If I fail to appeal during the contractually stated period, I automatically lose my rights. I'm wondering if the company fails to respond during the contractually stated period, what are the ramifications?

I don't know that email communication is a widely accepted method. Were any of your appeals sent in writing?

What was the situation, by the way? That might be helpful, so that we can even tell you if an appeal is justified.
