It was horrible legal advice. You came here for legal advice. Being told something that will create legally unrealistic expectations is horrible legal advice. Do you want to waste time pinning your hopes on tapes and e-mails that won't see the light of day in a court room, or do you want to be prepared with the legal reality of the situation?

The senior members here know what they're talking about, and you just benefited from their knowledge. For free. So, you got your feelings hurt. Big deal. If you want someone to pat you on the head and say "there, there" go to sobsisters.com. If you want legal help, listen to these people. A gift wrapped in sandpaper instead of silk is still a gift.

Several lawyers answered OP , including Ohiogal . Hate to burst your bubble , but if you think the senior members are being rude , wait till you get in a court room and are grilled by opposing counsel or a GAL . Why oh why do newbies insist they're being persecuted when they don't hear what they want ? If you want commiseration call a friend .

BTW...Recording conversations without consent is both a State and Federal crime...spacificaly a felony...up to 10 years in prison...Wire Tapping...look it up...

And if you think that we are rude...wait till a Judge hears this case....

And I just read up on it and it says i'm allowed to record phonecalls in North Carolina as long as there is firstparty consent sooo... Since I have a message from an answering machine (which is considered him consenting to the recording), I COULD USE THAT IN COURT.

u really just need to fish thru some of the bs moral advice and look just at the legal....dont take it seriously they dont know u or the whole of your case. Ive had nasy comments too, just ignore and worry about whats in front of u and the reasons behind it. Get the paternity straightened out, and think of how this will create rights to his visitation. Is the $ worth that? After 5 yrs? And ask yourself if u want to open up a can of worms which will be slimier and more gross as the court dates go on. I can promise that!

Do you know what to do to make sure any calls you do record are admissable in court ? To answer one of your original questions , NC does allow retroactive support for up to 3 years but only if you include an affadavit of expenses. Expect the presumed father to request custody and/or visitation as soon as you request support .

I had the same thing done to me 17 years ago. Denied me when I was 4 months pregnant.
call the attorney general in your state make an appointment. They will make a court date.
He will owe what is due.
My daughters birth father (donor...hasn't earned the right to be called father) didn't pay for 12 years and owes over 45,000. Next year when she is 18 the child support will end but he has to continue to pay until he has a $0 balance.
He has moved and stopped paying...they find him and he starts up.
So my advice is go to the attorney general and let them help you and keep it too yourself...and he is going to do is upset you and promise nothing.

I just wanted to note something that you stated in your very first post...

My son is almost 5 years old. His father and I broke up when I was 3 months pregnant, I left, never talked to him again, never even put him on the birth certificate.

YOU left. YOU didn't put him on the birth certificate, therefore YOU pretty much made it clear that YOU didn't want HIM in your or your child's life, IMHO. You're making it sound like he abandoned you when, in fact, you're the one that left and chose never to talk to him again. For all we know, he's tried to contact you, but you refused. Until you needed money, of course.

And just because you didn't state that you wanted the money for yourself for "rent or a car payment", doesn't mean that's exactly what you want it for. If you had a valid reason as to why you never asked for child support until now, when you want to move out, you might have gotten a different answer. But, I'm afraid that "I didn't want his money because my parents were taking care of my baby" is not valid. It seems more than a coincidence. You've said before that it's not your parents responsibility to take care of the child, so why didn't you file for support when the child was born? See how that doesn't make sense to anyone?

Don't be so quick to jump on these people for questioning your motives. If you're here just to get some sympathy, then you're in the wrong place.
