What is the name of your state? FLorida

I need to know if I have legal custody of my son by florida law. His father did sign the birth certificate but we have never been married, I am concerned that he can just come and take him from me. I am wondering if I am automatically considered to have custody because we weren't married and I'm his mother. I have not filed any custody case with our court system yet. I was under the impression that I have custody and the father would have to take me to court to have rights of custody or visitation. Is this true.

yes and no> By Yes I mean you have sole custody. HOWEVER, you have no papers to prove that and if he were to pick the child up from the day care or wherever -- he has that right because he is the father -- then the police would likely classify it as a civil matter and not get involved to return the child to you because he is daddy.
