Some of you have misinterpreted the care this girl was receiving although I don't know why. She was in a perfectly fine day care facility where she was learning & cared for, just home on weekends & evenings with her mom & an aide. Nobody wants to force the father to care for her just pay his fair share. He owed over $100,00 in alimony & child care before this tragedy happenned. My girlfriend can't even get into her mom's apartment to get clothes for her sister because the NYC police dept closed it as a "crime scene". My girlfriend showed the surrogates court the paid funeral bill plus the letter from her case manager stating her sister's disability but still they're making her wait. Her sister is in a temporary group home evenings & weekends & still attends her daycare facility during the day.

I'm not an attorney, but I don't believe your girlfriend would have any standing to sue her father for support of the disabled adult child. However, you might consult with a local estate attorney to see if a suit can be brought by her mother's estate to recover the unpaid alimony and/or child care. I have no idea whether this is possible, but if it were me, I would certainly check into it.

It's worth considering, although i don't know where she'll get the money to pay an estate attorney, which is why we're going to start with the agencies paying for her care, SS, medicare & medicaid.
