What is the name of your state? TX- I do not have custody of my son, my ex-husband has custody, I have remarried can they take in my husbands income also to determine child support amount? I know they take mine but I'm wondering if they can take in my new husbands income and combine both of ours.

Please use the search function, this same question has been asked and answered at least a thousand times or more.

I'll give you a hint: The only people who are legally responsible for supporting a child are the 2 parents of the child.

newwife, this may help. I haven't checked it to the code & can't swear to its accuracy

Only the NonCustodialParent's income appears to be used by Texas.

In most states, the income of both parents (not stepparents) are used. The calculator appears to only use the Ncp's income, with allowances for available deductions.

Maybe someone who practices Texas family law will come along & add info.

Texas child support is calculated as 20% of NCP's net income for one child. In addition, the NCP is usually also responsible for 100% of medical insurance premiums for the child and 1/2 of out-of-pocket medical expenses. Spouses' income is not considered in the calculation of support.
