I am posting this for a friend. Her unit failed the section 8 housing inspection, the landlord had 45 days to repair the unit, which the landlord has not done, they re-inspected on 3.16.07 and it failed again as the repairs were not made and the 45 days is up on 4.30.07. Is she responsible for the full amount of rent on 5.1.07 since she has not found another place to live? The housing authority said they would do a rental abatement and terminate the lease on 4.30.07.

Yes - she needs to pay full rent for May or give 30 days written notice and find other housing if she wants to continue with Section8....she needs to be in touch with the housing authority that issued her voucher about her options.

She will be accountable for rent (per her rental agreement) if Housing does not pay. I strongly urge her to contact her worker to find out how she can solve this problem. she could lose her section 8 if shes not careful. Housing not paying does not remove Landlords right to rent

The HA told her to give notice 45 days ago and find another place to live, which she began looking and is unable to get into another unit due to really bad rental credit (owing monies for damages). What exactly does rental abatement mean?

that the section 8 program is going to refuse to pay its share of the contracted rent amount. SO now comes a good kick from section 8 Its not likely they will back up your friend in a hearing for eviction for non payment based on section 8s claim that the unit failed its inspection, S8 s inspectors that I knew of in the past were total MORONS who didnt know squat about home construction and was what was normal for certain age homes. YOUR friend needs to get her city /county housing inspections dept in to order repairs or condemn it if they see fit. Your friend will still have to move NO Ifs ands or buts about that. Your friend needs to keep on trying to find a new LL who will participate in the program or end up in a shelter. Your friend needs to get as many of her things out of that unit as possible now. it will serve no purpose to wait , even if a condemn order from the city is written the only thing that means is that the LL may not be entitled to collect rent until the unit meets code. your friend will still have to leave.

If section 8 will no longer fund the tenant after 4/30/07 , then yes if She stays , it is her responsibility to pay the entire amount of rent .

She should now call the local building code inspector to inspect the property while she still lives there , and obtain the report . Often times the inspector will mandate the LL to repair within a certain period of time or face fines until the repairs are made .

Look up the State Landlord tenant law .

But unless there is serious habitability problems , she HAS to pay the rent , or face eviction .

Could it be that this is damage that she caused? If so, and the repairs are cosmetic I suggest that she pay someone to have them done.

You need to leave or pay rent its that simple. If you cannot find a place then mov einto a Motel many times Housing will give you emergency funds (up to 16 days in CA) for this. Your poor rental history suggest alaska might be right. Regardless unless you plan to pay rent and forfiet housing you need to move. By the way here in CA if you do not find aplace within a certain time frame you are dropped from housing. You need to have a serious talk with your worker or face losing your housing
