The people at the courthouse? All idiots.

I called a week or so ago and requested transcripts from the hearing for the restraining orders between me and ex that took place in October. I was armed with case numbers, the judge's name, courtroom #, time and date of hearing, etc.

The court reporter said "I can't help you, I don't have access to the tapes. Call the judge's clerk."

So, I did.

The clerk said "I can't help you, you need to call the court reporter. This time, tell her she does too have access to the tapes. If she can't help you, call back."

So I left a message with the court reporter, gave her all of the information again, and waited.

Then, I left another message and waited some more.

Today, I called the clerk again. She agreed to send me a tape of the hearing for $35, but warned me that it won't be of any use in court as it's not certified. I asked how to obtain a certified transcript, and she said "People ask that all the time, and I have no idea. Hang on."

When she came back, she said "Yeah, it's a tough question. No one knows. Send a money order for the tapes."

HELP! LOL How do I get a transcript?

That makes ABSOLUTELY no sense. There HAS to be a proceedure for getting a certified transcript of the tapes. Go ahead and at least get the copy of the tape.

You might try consulting with your former attorney on this. You can explain that you are filing a contempt motion on your own because you are tapped out financially. She may be willing to tell you the proceedure to get a certified transcript.

You're telling me! Gawd, I'm so frustrated right now all I can do is laugh about it since ranting makes me seem like a crazy person.

I'm ordering a copy of the tape just so I can make sure that the times I refer to what Stupidhead was told at that hearing, I'm quoting properly. Besides, I could sell copies ;)

I'm gonna try again to do a statute search, but I'm having NO luck there.

I doubt that there is a statute that outlines that proceedure. However, certified court transcripts are required for every case that goes to appeal, so there HAS to be a proceedure. It makes absolutely no sense that the court clerk can't tell you what that proceedure is. That isn't giving legal advice.

See if there is anything on your county court website.

I just ordered certified transcripts in MO for some civil cases. The court clerk sent me to the reporter who is doing the copies.

RULE 23. TRANSCRIPTS
Court Reporters - Transcripts, Deposits, Preliminary Hearings
A. Transcripts prepared for purposes of appeal. The court reporter shall prepare an original and three copies of the transcript. The court reporter shall file the trial court's copy of the transcript with the circuit clerk. The trial court's copy shall be printed in reduced-page format. The court reporter shall retain a copy of the transcript on computer disk in the event a full-page transcript is requested.

Heh. You forget I live in the boonies. We don't HAVE a county court website.

I have the letter that Stupidhead's attorney sent in requesting the transcripts for the appeal... it says
In compliance with Supreme Court Rule 81.12(e), I hereby request a record on appeal in the case of OUR NAMES case number XXXXXXXX.

In the transcript portion of the record on appeal, I request.....
So I looked up Supreme Court Rule 81.12(e) and it deals only with appeals, not requesting transcripts - and I'm not appealing anything, just trying to gather evidence for court.

Well, this is the problem, in more detail...

The reporter for 'my' judge is apparently on extended leave. So he can't make me transcripts. So, some other judge's reporter has to do it. Only, she apparently doesn't want to do it, or something because she claims she can't.

And... since I'm not appealing anything at all, I can't seem to get copies. I KNOW if I was appealing they'd have to make me copies. But I'm not. GRRRRR.

Perhaps you should add a second motion to your case asking the judge to order that you be provided with a certified transcript?
