What is the name of your state? vt. Contempt hearing tuesday. I brought in all my medical from last november to present. Found not in contempt. Now, my ex, who was pro se was allowed everything of my medical. The judge said he had the rights to it since he was acting as his own attorney. The judge informed him he was the ONLY one to see those medical records. He smiles and jokes, i can't even show my mother or my wife? Judge said NO. Can I get these back from him? Faith

ummmmm, i was ordered by the court to present my medical surgery notes, and why I was out of work to show my contempt was not willful. So "this" gives my ex the right to these??! Seems unfair! faith

How is it that that is unfair? Don't you think it is just as "unfair" that you would expect your ex to support your children WITHOUT the court ordered amount that you are supposed to be providing, without knowing why your contempt should not be considered willful. For crying out loud, what is in those records that makes their secrecy outweigh the obligation you have to your children?? And by the way, your medical records can't be that exciting. They are certainly beginning to bore me, as this is at least the 3rd thread that you have started relating to them.:rolleyes: :rolleyes: :rolleyes:

Umm...yes, it does give him the right because you are claiming that is the reason. So, as the other party, he has the right to the evidence as well for cross-examination. Why do you think it's unfair and that he doesn't have a right to all of the evidence? :rolleyes:

I know it's frustrating because your medical records are supposed to be private. However, you raised the issue of medical problems and once you did your ex was legally entitled to have copies of every piece of evidence that you presented in court.

It really isn't as bad as it sounds. My hubby had to give the court, his ex, CSE and the CSE's attorney copies of his medical records. They included surgical notes, MRI and other tests reports, notices from his Dr.'s stating he could not work, etc. It was, as we called it- "a neccasary evil" to give his ex copies.

Of course, you have the right to keep your records private, but if you had done that, you would most likely be sitting in jail right now for contempt. Just be thankful that the Judge actually followed the law and didn't make a finding of willful contempt.

Thank you. My concern is not giving him the records, my concern was him showing them to others. The judge told him to keep the records only for him to view and no one else. He said can I show my mom and wife? the judge said no. That is what my concern was. Thanks Faith

There's very little you can do.

Look at all the stuff in the news about "confidential" information being disclosed.

The judge can't follow the guy around 24/7.
