Hi all,

I got pulled over recently and the cop gave me a hard time about having a Florida license in California. I am aware that if I am a California resident I have to have a California ID and i have 10 days to aquire one. I am a Florida resident who has a rental in California. What are the laws surrounding this problem.

Are you a legal resident of FLORIDA or CALIFORNIA?

The fact that you rent rather than own a dwelling place in one location or the other is irrelevant to which state is is your prinicple legal domicle.

Are you in the military?
Do you maintain a principal residence in Florida (are you living there at least part of the time, do you pay taxes there, are you registered to vote there, do you file that as your address for federal tax)?

Well then, bring all of that up in court and see what happens. You may also want to research what elements make you a "resident" of California according to their laws. Ironically enough, the question of being a California resident has been asked and answered quite a few times on this forum, so some minimal searching should provide you with the answers your seek.

When you say he gave you a hard time, did he charge you with not having california license/registration or was he just giving you kindly legal advice as to the requirement to register?

Why do you think that living in FL part time, gives you residence there? Is the vehicle that you were driving registered to you? If not, where is it registered? You, do, by the way, pay taxes in CA as well, if you own a residence there. How much time do you spend in each state?
