Something else - his son mentioned to my boyfriend a couple of weeks ago when he was visiting his family in Ohio that he would like to live with us here in Florida. He is really focused on his Dad, they talk on he phone almost every night (which I think is great, I do the same with my son). His Mom constantly changes boyfriends and he told his Dad about it and that he doesn't like it at all. IF he decides to stay with us after the summer, how would we proceed ? He is almost 13 years old.

Its not that simple. If your husband were to attempt to simply keep him after the visit, your husband could very easily end up with even less visitation than he has now. That is a major no-no. If his father wants custody to change, then he needs to do it through the court system. However, if his father intends to follow through with kidnapping his child, child support doesn't stop.
We are by all means not intending to kidnap his son. I understand that it would have to go through the courts in Ohio and that it could take a long time, especially since she probably won't let him stay. LdiJ, I don't know the total extend of their custody and visitation agreement but I know that when my boyfriend was still living in Ohio, they had a pretty nasty court battle going on about custody, child support and visitation. I know that in the past, his son came to stay with his Dad for about a month during the summer vacation and Dad paid for the ticket every time. And she has never been cooperative. For her, it's all about the money - sigh - like for so many other women too.
I'm just glad that my first husband and I could be civil with each other and come to a custody, child support and visitation agreement without involving the courts. Our children both tell us all the time that they are happy that Mom and Dad get along so well and they also know that we did it for them.
When it comes to child custody, child support and visitation court battles, the children are ALWAYS the ones who lose because Mom and Dad don't have any control over the children anymore. Mom and Dad know what's best for the kids, not the courts.

Yes, he has had him over the summer before, except last year - as far as I recall she took him on vacation with her and her boyfriend. I would have to ask my boyfriend what exactly the court ordered visitation says. Last night we just discussed the fact that he will still have to pay child support for the time that his son is down here for a month and that his Mom won't pay for the plane ticket.
