Doctor appointments

What is the name of your state? TN

My husband's ex has "sole care, custody and control" of their 8 year old daughter. Is he allowed to make a doctor's appointment and take her without permission from the mother? (There is nothing in their order stating anything otherwise.)

Out of curiousity, why wouldnt he just tell mom? If the child needs to go to the doctor, I am pretty certain mom is not going to say no.

Well, the problem is that mom doesn't want dad to take the child. Their daughter was diagnosed with asthma a while back by a pediatrician and my husband has expressed concern to mom that he wanted to get a second opinion from an allergy specialist just to confirm. She refuses. He even spoke to her pediatrician and got her approval to see a specialist and mom still says she doesn't want him to take her. He's concerned she may be on meds that she doesn't need to be on. Will he be okay to take her?

Does the child have insurance? If so, who provides it? And...what does your custody agreement say regarding medical care?

If mom has sole care, custody and control then mom is the only one that can make such decisions. Dad doing so would be in contempt. Dad needs to take mom back to court to force the issue for joint.
 
Chelle, the child does have insurance. My husband provides it. And the only thing that the order states about medical is that both parents are responsible for half of all costs.

OG, mom and dad were recently in court to modify their current order and dad did request to have all medical decisions made jointly and was granted it. Only problem is, the order has yet to be signed by mom's attorney, and therefore hasn't been signed by the judge yet.

He needs to have that order signed. Until he gets that showing that he has a right to make medical decisions he may not find a doctor that will treat the child on his say so except for emergencies. Once he gets the order he can make an appointment.
