What is the name of your state? Oregon

Alright. This comes from a few working at Oregon State Hospital. We're having a hard time finding information on audio and video "recording" devices being allowed in hospitals. Primarily, there is now a problem that all newer technology devices, such as mp3 players, radios, computers, and the one that's annoying most, cell phones, that have built in cameras and microphones. What we want to know is, what, if any, laws that specifically deal with this issue, both Federal and State, and what they're about, such as the devices, or the act of making recordings itself. We're hoping that once we can get some resources about this issue, that we may be able to get things clarified, and perhaps even get the rules loosened up. Or at least where to get started. A lot believe that there is serious confusion about what is actually and not allowed, and why. They say cell phones are allowed, but not ones with cameras, but then a large portion (probably > 95%) of phones now have them, which is limiting a lot of peoples choices in terms of getting one.

Thank you!

If you are truly confused about WHAT is actually allowed, ask. As for 'why'... they don't have to explain their rules to you.

They say cell phones are allowed, but not ones with cameras, but then a large portion (probably > 95%) of phones now have them, which is limiting a lot of peoples choices in terms of getting one.
And of course, that is NOT true. You can go out and buy the biggest, baddest camera phone you want (I really like my Moto Q).... just don't take it to work.

This is really very simple.
Your employer OWNS the property and, thereby, has the right to set the rules for your conduct on THEIR property. If they want to prohibit your using cell phones, MP3 players or any other OPTIONAL non-protected right, they can. There is no legal protection giving you the right to listen to your MP3 while at work.

If you don't like their rules, find another job.

Hospitals often don't allow cell phones in certain areas of the hospital where signals may interfere with hospital equipment. There are probably signs posted saying this. Video recording is not against the law in Oregon but audio taping can be if at least one participant is not aware that recording is taking place. Any use of devices such as mp3s can be regulated by the hospital itself.
