What is the name of your state? TN

This may be a silly question, but we just wanted to make sure. :eek:

My husband's CO states that his daughter will become emancipated at 18 or when she graduates highschool. His CS is currently being set up through CSE (he just recently had his CO modified and setting up through CSE is one of the things he requested) and he will be sending them a check bi-weekly instead of sending it straight to his ex. When the child turns 18 (or finishes highschool), will he just stop sending the payments to CSE or will he need to petition the court to end the payments?

Well, um, you asked a question and got an answer. It really doesnt have to make sense to you. If you dont want to make absolutely sure that the CS ends, then dont petition the courts--since you dont think it makes sense. Problem solved.

J, there's really no reason to get snippy. I wasn't questioning the response I got. I was more or less thinking outloud...seeing as the CO already states that CS should end at a certain time, one would assume that it would be automatic without further action being needed. Am I wrong for thinking that?

Why doesn't it make sense? How will the CSE know when she graduates from high school?
She might have been held back a year...

Yeah, you have to petition the courts. Make sure you do it a few MONTHS before you expect the date of c/s to end, because it takes them awhile to get ppl into court (I'm sure you have noticed...) and he will be responsible for any support after she turns 18/finishes hs until the CO is modified. I think thats absurd, but thats CSE for ya, right? :rolleyes: ;)

As the others have said, he may have to petition the court. However, before he does that he should talk to his caseworker. My nephew just turned 18 and his Dad was able to stop the CS simply by notifying the CSE agency in TN.
