Employment contract not signed by both parties

Not sure where to post this, Hubby was working for Kirby as a wholesale dealer. He made a contract between the distributor and it was never signed by the distributor. Is it still enforceable? Also they are withholding his commission because they went on a trip last weekend to sell sweepers, that he volunteered for, and was NEVER told they would take the cost of the trip out of his commission. Now they are telling him that is why he isnt getting paid for his sales. What can he do? Thanks for all your help

What are you trying to enforce? What agreement has he been paid under so far? The unsigned contract might be evidence of the terms of an oral agreement, though not enforceable on its own. Or it might not.

Unfortunately, your husband should probably have asked who was to pay for the trip before he went.

He hasnt been paid, this was supposed to be his first pay period and he was suppose to pay him for commission for any sales that he made the week before, plus he gave him an incentive of 50 dollars for every appointment he made, which was on the flyers on the wall, which my Hubby brought home. As far as the trip goes, he was told since he was new he needed to go, and that he would get a bonus if he went. He was told, in the meeting in front of everyone, that the company would furnish transportation, eats, and hotel. When they got down there, they had only paid for the room and gas. Everyone has quit since then. Thanks for your help.

Is this Kirby the vacuum cleaner company? If so, I thought they'd sleazed themselves out of business a long time ago...
