My brother ( age 38 ) is harassing me ( 36 ) by calling my cell phone at 4 to 5 AM and other odd times. What can I do about it?

Cell phones do not block out unknown calls. The calls come in as Unknown.

Several years ago we owned an apartment building. We had irreconcilable differences and he filed for a partition of the property. Like a divorce. I ended up getting the property and buying him out.

Ever since I moved back into town he has been calling my cell phone. I changed the number 3 times because of him. This time I know it was him but have no proof, other than coincidence.
My uncle gave him my number thinking I should invest in a real estate deal that my brother had to offer. Of course I didn’t go into that deal, but low-and-behold the Unknown calls have restarted.What is the name of your state?

While you can't BLOCK an unknown number, you CAN set your phone to not ring for unknown numbers. Mine is set that way. It won't stop him calling, but it will stop him from waking you up when he does.

It doesn't sound like harassment. It sounds like annoying behavior. And, if it's an unknown number, you can't prove it's him anyway... legally, you're out of luck.

Another good tactic is to say, "Let me put you on hold for just one second."

Then go mow the yard.
At 5am?! Then her neighbors will be calling wondering what they can do about their neighbor's annoying habit of mowing the yard at the buttcrack of dawn!

**A: simple, change you phone number again and do not give the number to your uncle.

I havent figured out how to do that on my phone, Motorola MPx 220 . ( if you find directions ) hehe.

Pretty sure it can be done on any phone. When setting ringers for 'family', 'friends' etc... people IN your phone book, you can also choose to set ringers for those NOT in your phone book (and unknown numbers, by default as they CAN'T be in your phonebook). Set THAT ringer to silent.

Annoying and harassing calls is a misdemeanor crime in CA. If you want to, report it to the police and see if they can speak to him. if he lives out of county or out of state, it's not likely they will issue an arrest warrant for him if it continues, but it might rattle his cage a bit if the cops get involved.

You can also seek a restraining order against him preventing any contact - that has a little more teeth and tends to be enforceable anywhere. However, the same distance problem will apply with regards to arrest warrants.

do law enforcement have the means of obtaining the route of the unknown number once a complaint is filed? Because the actual number is unknown to me.

There are ways to subpoena the information from the phone providers, or obtain search warrants, but for this sort of crime we rarely go that far absent some very serious - and credible - threats to the victim's well-being.
