help I got ripped off on ebay

I bought a world of warcraft account on ebay. I've been playing it for about 3 months now. A few days ago I tried to log in and the password was changed. Then I tried to do the password recovery thing and the email was changed too. I sent an email to the guy I bought it from yesterday asking what was up and didn't get a response. So, I sent another and told him that he has one week to give me either the account of my money back or I'm going to file fraud charges with paypal and contact the authorities.

I just got an email from him. He closed his paypal account and I guess his ebay account got suspended shortly after I bought the account from him. He says that he doesn't know anything about why the password and email have changed on the account. I told him I didn't believe him.

He says there's nothing I can do anyway because Blizzard is the owner of the account not me or him and all he was selling me was the information I used to log into the account. He said that it's not fraud because he sent me what I bought in the auction which was the log in and password for his account and because the character on the account was exactly what it was in the auction. He still denies that he was the one who changed the password and stuff.

So I read on blizzards website about the rules for world of warcraft accounts and it does say that blizzard owns the accounts and that the only person who has rights to the account is the person it was originally registered to. It is true that everything he advertised in the auction was true about the character and it didn't actually say that I own the account or anything...it just said that the winner of the auction gets an email with the log in information. He has proof that I got that email too...because I replied to it and my email puts all the previous messages at the bottom. So I can't say that he never sent it to me...

Is this guy right? Is there nothing I can do to him legally? He says he's not breaking any laws and won't admit that he was the one who changed the password. Is there anyway I can get my money back from him? He closed his paypal before I had a chance to open a dispute...plus it's been 3 months since the transaction. Ebay doesn't allow the sales of world of warcraft accounts on their site. So they might not like it if I told them I bought one on there and he's already banned from ebay.

Ok, so you know eBay doesn't allow the sale of the accounts.
You know that WoW doesn't allow the sale/transfer of accounts.
You know that the guy actually DID deliver exactly what he said he would.

What is your question again?

My question is...what can I do to either get the account back or get my money back? Or at least is there anything I can do to bust this guy? If I call the cops will they do anything for me?

Actually, I know that he did deliver all that he claims he was obligated to deliver. But come on...why would I buy some guys log in information for 200$ just to have him take the account back three months later? It's kind of assumed in these sales that the person paying the money gets to play the account from then on...and I didn't get that.

First, you went in to this transaction with full knowledge that it was "against the rules".
Second, you have no proof of what happened to the account.
Third, you DID get to play the account until it was locked out.

You have no further recourse.

Nothing at all??? There has to be something I can do...I didn't actually know for a fact that it was against the rules until I looked it up just now.

Screwed in this instant but what is stopping you from purchasing World of Warcraft correctly, subscribing, and playing it? You broke a well known gamers rule and was caught, so did your Ebaying friend. Most likely I would bet that your Ebay friend knew this going in and took the chance anyway.

No most likely you would just be out more money, time away from your job, and travel expenses. The judge would most likely dismiss the case and you would eat the loss of the game, the time away from your job and travel expenses.

You have no cause to sue. You participated in an illegal act thus giving up any rights to sue for your loss. You answered your question in a previous post of yours.

You're pretty much SOL on this one. eBay and PayPal generally require you to take some sort of action with 30 days to combat alleged auction non-performance.

My question for you is, why didn't you immediately change the email, log in and password for your world of warcraft account you purchased? This was a poor decision on your part.

There's a very remote (very very remote) chance that you could recoup funds by banding together with other alleged victims to pursue a lawsuit. But the odds of this happening are slim and none. Not to mention your losses probably don't amount to much more than a few dollars. It most likely wouldn't be worth your time and energy to pursue.
