neighbor trying to do away with 50-year-old alley easement

To make a long story short, our neighbor's son is the class bully at school, taking it out on my son all year. Short of filing a sexual harrassment suit for the most recent offense, I made sure this kid was taken care of. Ever since then, his parents have now turned into the neighborhood bullies and have been taking it out on us! They have called the police for the most trivial stuff....an "exposed" cord that ran from our pool to an outlet, our kids riding bikes/go-carts on our own driveway without helmets, and even when someone had to go around the bikes that they used to block off "their" section of the alley....she went a little bit onto this neighbors grass so she called the police.

Their most recent "project" is trying to revoke an easement for an alleyway that cuts through 4 properties as a second access to our commercial space we own behind our house. My grandfather had this easement added the deed 50 years ago and now this couple is banding the other 3 landowners together to try to get it changed. The township has told them that they can't change an easement but they can place a weight restriction on what can use it. They've submitted pictures and documentation of big rigs (sometimes 18-wheelers) that come thru. Our other entrance isn't large enough for bigger trucks to use. What kind of defense to we have, if any? They've also been blocking off "their section" of the alley so vehicles can't pass through. They've even posted "Private Property --- No Trespassing" signs at either end, which is confusing the tenants/customers that typically use it.

When does it turn into harrassment?:confused:

I would suggest you contact a real estate attorney and fast. They are restricting your trade with their actions. A curt letter from an attorney with suggestion of a lawsuit may curtail them.

I also would contact the township trustess with documentation that you need to use the easement alley to deliver goods to your business. Without it, there is no way of delivering those goods and supplies, essentially putting you out of business. Show them pictures of their restrictions (bikes, private property signs, etc.) They should not allow the other homeowners to restrict access to this area that you need for business. Get the township to rescind their restrictions. Then if they put bikes, or whatever, in the way, I sure hope a big rig doesn't accidentally run over them. That would be terrible.

Good idea. I will make sure to get those pictures right away. We want to meet with the township ASAP but we're wondering if it would be in our best interest to take legal council with us....big bucks probably, but worth it in the end.

I'm going to work on drafting a letter to present at the meeting, as well. This alley has been used for the same purposes for the past 50 years without complaint. How is it that someone with a personal vendetta can come in and take that away from us?

I drive an Excursion that my husband lifted...driving a big "monster truck" like mine, sometimes it's hard to see the kids bikes way down there that I'm about to run over.....or may run over, I should say. ;)

Just make sure you have the $ to pay for any bikes you might run over due to not being able to control your vehicle properly. And, just pray to whomever that there is no kid on that bike you can't see...if you can't see the bike, you can't see the kid.

OMG, I would never run over their bikes, let alone their kids. I was kidding. :eek:
