There are no other rules, the rules we get in school we are told are the "SCHOOL RULES". The SCHOOL RULES are flawed, and are not what we were told. Is it really me thats not understanding the facts?

When somone tells me i'm stupid, i'm going to inform them otherwise. I dont think im a genius, but i am most definately not stupid.

She is supporting my efforts to stay in school, as im sure any GOOD parent would. She does not in any way approve of my smoking.

So, since you're so bright, you've found out all about your teenage "rights" since I last taught you your civics lesson??? And what did you learn? :p :D

So...how psycho are you? Buddy, you might wanna fix that. After reading some of your other posts, i just decided not to take anything you say the least bit seriously, because it seems to be a trend of yours to say stuff that is useless, and a tad bit crazy. Honestly, a 2 year member with 5,300+ posts? Dont you have friends? or a life? aparently not, which explains your need to say/do things that arent normal for people to say...lack of human contact WILL do the trick.

Strange - seems to me that, with the backing of your mom, you could serve your rightfully earned suspension and STILL keep up with your work (teachers will send home work for you to complete, or at least a listing of what you should keep up on in your books).

Strange, because no matter how many times the school says theyre going to send home work, they never do. I'm not sure about your school, but in my town parents have gone so far as to try and outlaw suspension because no one ever follows through with anything, and the students are left with a workless vacation, and return to failing grades.

If it's true you get good grades, a ten day suspension would hurt your grades but not make you fail your classes. Your grades must only be passing. And that's total b.s. about not being able to get the assignments to do while on your suspension. What's stopping you from going to each of your teachers and asking them to tell you what their teaching plan is for the ten days and what assignments they plan to give the class to do? Nothing is except your inability to take the initiative yourself instead of waiting for someone else to do it for you.

Not neccesarily ... our school district will not allow the student to turn in work/take test while on OSS. Stupid in my opinion, but the rule none the less. They do try to utilize ISS for circumstances like this though.

Give me a cite for CT law stating that anyone under the age of 18 can possess or use tobacco.

Don't tell me that I ought to look for it myself. You're the one making the assertion that it's legal, so you should be the one to prove that your statement is correct.

Since CT law states that:
(b) Any person who sells, gives or delivers to any minor under eighteen years of age tobacco, unless the minor is delivering or accepting delivery in such person's capacity as an employee, in any form shall be fined not more than two hundred dollars for the first offense, not more than three hundred fifty dollars for a second offense within an eighteen-month period and not more than five hundred dollars for each subsequent offense within an eighteen-month period,

how is it legal for someone under 18 to possess tobacco? No one in CT is allowed to sell, give, or deliver tobacco to someone under 18. It's hard to smoke when you can't get tobacco from anyone.

I am impressed with your desire to fight the 10 day suspension. I, personally, think you have a legitimate argument against suspension (if the suspension was, in fact, only for the smoking and not for leaving school grounds to do so).

Based on the rule book, the rules of which you agreed to, you were not violating the school's smoking policy by leaving school grounds to smoke. Therefore, the school should not be able to suspend you for a violation of school's smoking rules. According to the rule book, there was no violation. I do not believe you should be held liable for the school's error and omission.

If the rule book said, for instance, that no student can wear the color purple, and you agreed to that rule, then you would not wear the color purple. If one day you wore orange, however, and the school suspended you for wearing orange because they forgot to mention in the rule book that orange couldn't be worn either, it would be just as unfair as the current suspension you are facing. I think the fact that you were smoking is getting in the way of the facts for some people.

If you were in a debate class, you could very well win. I am not sure you will have much success with your appeal, but I wish you luck, just the same.

(Just an added note: Although some studies have reported that 90% of all smokers start smoking at or before the age of 18, the legal age in most states, including Connecticut, is 18, and if you are under 18 and smoke, you are committing an "incorrigible act", or an act which is unlawful for kids but not for adults)
